General Conditions of Sale
By ordering our products, you agree to the following conditions.
www.pomdazur.com after clicking on the "Buy Now" button constitutes a binding offer to purchase the product in accordance with these General Conditions.
Orders are subject to acceptance by Pom d'Azur. We reserve the right to accept your order within 14 days of receipt or to reject it, explaining our decision.
The binding contract of sale of the products you have ordered is only effective when we accept your order. You can consider your order as accepted when we send you an explicit confirmation by email.
Delivery / Transfer of ownership and risks
If the ordered products are in stock, a delivery service engaged by us will deliver them to the address specified in your order and in our order confirmation within ten days of conclusion of the contract. If the products are to be manufactured, delivery will take place after six weeks.
You will only receive ownership of the delivered products after you have paid the full purchase price. We may retain the products until full payment has been made and the withdrawal period has expired.
Notification regarding withdrawal
If you are a consumer within the meaning of Article L. 221-18 of the Consumer Code, that is to say that you are acting as a natural person making a purchase on www.pomdazur.com for purposes that are primarily outside your trade, business or profession, you have the following right of withdrawal:

The statutory warranty rights apply to all products in our online shop.
Responsibility
Pom d'Azur is liable for damages under the statutory warranty and other legal bases, in particular for tort, organizational negligence, fault in the conclusion of the contract or other breaches of duty, only in the event of intent or gross negligence on the part of Pom d'Azur, its legal representatives or vicarious agents. The above limitation of liability for cases of minor negligence does not apply to damages resulting from injury to life, body or health or from a breach of essential contractual obligations. In such cases, Pom d'Azur is also liable for minor negligence on the part of its legal representatives or vicarious agents.
Others: Restrictions on transferability, place of jurisdiction, dispute resolution
The request for delivery of the ordered products may only be transferred to third parties with our prior written permission.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
In commercial transactions with merchants, Paris, France, is the agreed place of jurisdiction for all disputes arising from these General Terms and Conditions. Pom d'Azur is also entitled to sue at the customer's place of business.

Pom d'Azur is also committed to resolving consumer disputes under the law on alternative resolution of consumer disputes.
If any provision of these Terms and Conditions is or becomes invalid or unenforceable, this will not affect the validity of the other provisions.
